Zeus Secure Messenger Privacy Policy
Your privacy is important to Zeus (“Zeus,” “we,” “us,”“our”). Zeus has created this Privacy Policy (“Privacy Policy”) to demonstrate the commitment to protecting your privacy and to explain the personal data Zeusprocesses, how Zeus processes it, and for what purposes. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information.
Overview
We strongly support your right to privacy when using our apps. Our privacy policy issimple: your data is none of our business. We make money by selling software, not by mining your personal information.
To the extent that our apps and websites can provide their functionality without doing so, we prefer to avoid collecting data from you. In the cases where we do collect data, we try to be clear about why we're collecting it, tell you how long we keep it and delete it when we no longer need it.
We use modern security measures to protect collected data, and limit access to only those employees who require access to perform their jobs. We may be legally required to disclose collected data to law enforcement or government agencies in some situations.
Zeus Messenger is a peer to peer app that does not need a server and therefore does not ever connect to us so we never get any data from your device even in the event of a crash.
You now have 2 layers of e2e encryption with outstoring anything in any servers and only using onion v3 connections, all your messages are stored encrypted in your phone using your password, including all media messages and audio messages.
· Completely peer to peer using hidden services
· We don't operate any storage servers, all your data is stored on your device only.
· We use the signal protocol over onion v3 protocol to give you two layers of end2end encryptionthat can only be decrypted by your contact.
· You never register with us, instead you start a tor onion service and communicate with your contacts through their tor onion service, without ever using a server.
Website, GooglePlay or AppStore Purchases
If you purchase aproduct directly from one of our websites, we collect your:
· full name
· address
· company name (optionally)
· email address
The purpose ofcollecting this information is to identify you in the future as a license ownerof one of our applications. We may need to verify you are a license owner if,for example:
· you contact us for support
· you request areceipt or invoice
· you request a refund
· you request that we re-send your license file or serial number
· you wish toreceive discounted upgrade pricing on an app you've previously purchased
Because addresses,both real-world and electronic, tend to change over time, having more than one piece of identifying information helps ensure we can find a record of yourpurchase should you need help down the road.
We do not sell orotherwise disclose this information to third parties, except as required tocomplete your transaction. For example, we send it to our credit card processoronce at the time of purchase in order to authorize the transaction.
We do not collect orstore your credit card number, expiration date, or CVV code. When you purchasefrom our website, your credit card details are routed directly from yourbrowser to our credit card processor, and are not stored on any Zeus-ownedserver even temporarily.
You may updateyour personal information with us at any time by contacting us.
We retain thepersonal information related to your purchase indefinitely to facilitatesupport interactions, unless you ask us to remove it. To request removal ofyour personal information related to a purchase, contact us. If you dothis, be sure to keep a copy of your purchased serial numbers or license files,as we will no longer be able to look them up once we have removed youridentifying information from our system.
Support Interactions
When handlingsupport requests from you, we collect:
· your email address
· any informationyou provide voluntarily (such as crash logs or other diagnostic info)
This informationis collected solely to help resolve your support inquiry. We retain support emailsindefinitely in order to:
· have context fromprevious interactions which may help us answer your future questions morequickly
· identify broadtrends in support requests, which may help us identify and solve problems withour products
If you would liketo remove support emails you have sent, contact us.
Application Usage Analytics
None of our appscollects information about the way you use them. We do not track any userbehavior in our apps. We do not receive any information from your devices,displays, cameras, or microphones.
Crash Logs
None of our appshas built-in crash log collecting, which means if one of our apps crashes whileyou're using it, we do not know anything about the crash until you contact usabout the problem.
Google (on Androiddevices) and Apple (on iOS/Mac OS) may collect crash logs if the privacysettings of your device allow it. Those companies may later provide the crashlogs to us.
If either youprovide us with crash logs or we receive them from those companies, we do notshare any information from them with any third party.
Update Checking
For iOS andAndroid apps or apps acquired from the Mac App Store, update checking behavioris managed by the operating system, and the relevant information is processedby Apple or Google.
For apps acquiredvia direct download from one of our websites, there is no update checking.
Email List
On our website,you can subscribe to a newsletter about one or several of ourproducts. Additionally, the email address used for a purchase of one of our productsis added to the product's email list.
Our email list islow volume (usually no more than a couple of messages a year) and is generallylimited to announcements of important new versions of our apps or significantnew product releases.
We do not sell orotherwise disclose any portion of our email list to third parties.
If you join ouremail list, we retain your email address until you ask to be removed.Instructions on how to unsubscribe are contained in all messages sent to theemail list. For your convenience, you can also unsubscribe directly on this page.
Cookies
A cookie is a small file that resides on your computer's hard drive and enables us to monitor areas of our website. This information is collected and aggregated, and in no way does this unique identifier identify a user personally. Our site tracking cookies contain no name or address information. They consist only of a uniquelygenerated random number – this is how we differentiate visitors.
Third-PartyVendor Services Used
· Credit card processing for purchases from our websites is provided by FastSpring, PayPro, PayPal and stripe
· Paymentprocessing, update checking, and license management of apps purchased from theMac App Store are managed by Apple.
· Update checkingfor apps downloaded from Google Play is managed by Google.
How to access and control your personal information
Access, Edit and Delete Your Information.
· EEA Resident. Ifyou are a resident of the European Economic Area (“EEA”), your rights toaccess, edit and delete your information can be found in the European PrivacyRights section of this Privacy Policy. If you are a California resident, yourrights to access, edit and delete can be found in the California Privacy Rightssection of this Privacy Policy.
· Non-EEA Resident.If you are not a resident of the EEA or California, you may be able to makerequests to access, correct and/or delete certain personal information that youprovide to Confide. For your protection, we may require proof and verificationof your identity and jurisdiction of residency before we can answer anyrequests. If you wish to make such a request, you may contact us. If we changeor delete your personal information or if you decline to actively share certainpersonal information with us, we may not be able to provide you with ourservices or some of the features and functionality of our services. Once wehave verified that you own the account, we will honor such requests at ourdiscretion and in accordance with applicable law.
· Device Permissions.Mobile platforms have permission systems for specific types of device data andnotifications, such as camera and microphone as well as push notifications.Where applicable, you can change your settings on your device to either consentor oppose the collection of the corresponding information or the display of thecorresponding notifications. Of course, if you do that, certain services maylose full or partial functionality.
· Uninstall. You canstop all information collection by the app by deactivating your account andthen uninstalling the Confide app using the standard uninstall process for yourdevice. If you uninstall the Confide app from your mobile device, the uniqueidentifier associated with your device will continue to be stored by us. If youreinstall the application on the same mobile device, we will be able tore-associate this identifier to your previous transactions and activities.
· Email. If youreceive a commercial email from us, you may unsubscribe at any time byfollowing the instructions contained within the email. You may contact us ifyou decide to opt-out from receiving commercial emails and any otherpromotional communications that we may send to you from time to time. Please beaware that if you opt-out of receiving commercial email from us or otherwisemodify the nature or frequency of promotional communications you receive fromus, it may take up to ten (10) business days for us to process your request,and you may receive promotional communications from us that you have opted-out fromduring that period. Additionally, even after you opt-out from receivingcommercial messages from us, you will continue to receive transactional oradministrative messages from us regarding the services.
· Notice to NevadaUsers. Under Nevada law, Nevada residents may opt-out of the "sale"of certain "covered information" (as defined under Nevada law)collected by operators of websites or online services. We currently do not sellcovered information, as "sale" is defined by Nevada law, and we donot have pP2Ps to sell this information. However, if you would like to benotified if we decide in the future to sell personal information covered by theNevada law, please contact us. You are responsible for updating any change inyour email address by the same method and we are not obligated tocross-reference other emails you may have otherwise provided us for otherpurposes. We will maintain this information and contact you if our practiceschange.
· InternationalTransfers. Our services are hosted in the United States. If you choose to useour services from outside the United States, with laws governing datacollection and use that may differ from United States law, note that you aretransferring your personal information outside of those regions to the UnitedStates for storage and processing. We may transfer your data from the UnitedStates to other countries in connection with the storage and processing of datato operate our business. By using our services and providing personalinformation, you consent to such transfer, storage, and processing.
· MarketingOpt-Outs. Some of the third party service providers we use to market ourservices and show our ads on other websites and mobile applications mayparticipate in the Digital Advertising Alliance's (“DAA”) Self-RegulatoryProgram for Online Behavioral Advertising. To learn more about how you canexercise certain choices regarding Interest-based Advertising on the websitesand mobile applications that you visit and use, including use of Cross-deviceData for serving ads, visit www.aboutads.info/choices, andwww.aboutads.info/appchoice for information on the DAA's opt-out programspecifically for mobile applications (including use of precise location forthird party ads). Some of these companies may also be members of the NetworkAdvertising Initiative (“NAI”).
· Should you allownotifications within the Confide mobile application, we may send you offers andpromotions related to Confide. You may opt-out of these through the settingsmenu on your device.Third-Party Vendor Services Used
Children's privacy
Confide does not knowingly collect personal information from childrenwithout appropriate parental or guardian consent. If you believe that we mayhave collected personal information from someone under the applicable age ofconsent in your country without proper consent, please let us know using themethods described in the Contact Us section of this Privacy Policy and we willtake the appropriate measures to investigate and address the issue promptly.
European privacy rights
Choices and Rights. As a resident of the EEA, you may have some or all ofthe following rights in relation to how we use your personal information:
• Access: you may requestaccess to your personal information and receive a copy of it;
• Correction: you mayhave inaccurate/incomplete personal information corrected and updated;
• Object to, or Limit orRestrict, Use of Data: in some circumstances, you can ask us to stop using allor some of your personal information or to limit our use of it;
• Deletion: in certaincircumstances, you can request a right "to be forgotten" (this is aright to have your information deleted). We will honor such requests unless wehave to retain this information to comply with a legal obligation or unless wehave an overriding interest to retain it;
• Portability: in certaincircumstances, you can exercise the right to data portability (this is a rightto obtain a transferable version of your personal information to transfer toanother provider);
• Consent Management:where we rely on consent to process your personal data, you may withdrawconsent at any time. You do not have to provide a reason for your withdrawalwhere processing is based on consent; and
• Right to Complain: ifyou are unhappy with any aspect of our data processing or privacy practices,you have the right to complain to your local privacy supervisory authority, alist of which is available here.
If you are a resident of the EEA and you wish to exercise one of the legalrights mentioned above, you may contact us. Keep in mind, we may rejectrequests for certain reasons, including if the request is unlawful or if it mayinfringe on the rights and freedoms of another person.
For your protection, we may require proof of identity and verificationbefore we can answer the above requests.
Basis for Processing Data. We may rely on the following legal grounds whenit comes to processing personal information:
• Legitimate Interest.There may be a legitimate interest to process the personal information that wecollect, such as to develop, administer and support our services; to operate,evaluate and improve our business; to facilitate and manage engagementprograms; for the purposes of operating and helping ensure the security of ourbusiness, to promote research and innovation; or to facilitate a CorporateTransaction (including a sale of assets or merger or acquisition).
• ContractualObligations. We may process personal information to fulfill our terms ofservice with you or our contracts with business partners, such as third partiesthat distribute our products, or to fulfil requirements under our EULA andproduct terms and conditions.
• Legal Claims. It may benecessary for us to process personal information to establish, exercise ordefend against fraud, illegal activity, and claims and other liabilities,including by enforcing the terms and conditions that govern the services weprovide.
• Legal Obligations. Ourprocessing of certain information may be necessary to comply with our legalobligations and for reasons of public interest, such as with respect to adverseevents and product safety reporting.
• Permitted by Law. Wemay process personal information as specifically permitted by applicable legalrequirements.
If we rely on consent for the processing of your personal information, wewill seek such consent at the time we collect your personal information.
International Data Transfer. We may transfer your personal information tocountries other than the country in which the data was originally collected forthe purposes described in this Privacy Policy. For example, if you are locatedoutside of the United States, we may transfer your personal information to theUnited States, where Confide is headquartered. The countries to which wetransfer personal information may not have the same data protection laws as thecountry in which you initially provided the information. When we transferpersonal information across borders, we consider a variety of requirements thatmay apply to such transfers.
We only transfer personal information from the EEA to:
• countries the EUCommission has deemed to adequately safeguard personal data;
• pursuant to therecipient's compliance with standard contractual clauses (also known as ModelClauses), or Binding Corporate Rules;
• pursuant to the consentof the individual to whom the personal information pertains; or
• as otherwise permitted byapplicable EEA requirements.
California privacy rights
If you are a California resident, we process your personal data inaccordance with the California Consumer Privacy Act (“CCPA”). This CCPA sectionof our Privacy Policy contains information required by the CCPA and supplementsour Privacy Policy.
Access to Information and Data Portability Rights. You have the right tosend us a request, no more than twice in a twelve-month period, for any of thefollowing for the period that is twelve months prior to the request date:
• The categories ofpersonal information we have collected about you.
• The categories ofsources from which we collected your personal information.
• The business orcommercial purposes for our collecting or selling your personal information.
• The categories of thirdparties to whom we have shared your personal information.
• The specific pieces ofpersonal information we have collected about you.
• A list of thecategories of personal information disclosed for a business purpose in the priortwelve (12) months, or that no disclosure occurred.
• A list of thecategories of personal information sold about you in the prior twelve (12)months, or that no sale occurred. If we sell your personal information, we willexplain:
o The categories of yourpersonal information we have sold.
o The categories of thirdparties to which we sold personal information, by categories of personalinformation sold for each third party.
You have the right to make or obtain a transportable copy, no more thantwice in a twelve-month period, of your personal information that we havecollected in the period that is twelve (12) months prior to the request date.
Data Deletion Rights. Except to the extent we have a basis for retentionunder CCPA, you may request that we delete your personal information that wehave collected directly from you and are maintaining. Note also that we are notrequired to delete your personal information that we did not collect directlyfrom you.
Exercising Your Rights. To make a request for access, portability, ordeletion according to your rights under CCPA, you may contact us. Californiaconsumers may exercise these rights via an authorized agent who meets theagency requirements of the CCPA. We cannot respond to your request or provideyou with personal information if we cannot verify your identity or authority tomake the request and confirm that the personal information relates to you. Anyrequest you submit to us is subject to an identification and residencyverification process ("Verifiable Consumer Request”). The VerifiableConsumer Request must:
• Provide sufficientinformation that allows us to reasonably verify that you are the person aboutwhom we collected personal information or an authorized representative. Youagree that in order to accommodate certain requests by you, we may require youto verify your ownership of an account by responding to a text message sent tothe phone number on the account and/or by requesting reasonable documentationto show your ownership of the number and account.
• Describe your requestwith sufficient detail that allows us to properly understand, evaluate, andrespond to it.
Some personal information we maintain about consumers is not sufficientlyassociated with enough personal information about the consumer for us to beable to verify that it is a particular consumer's personal information (e.g.,clickstream data tied only to a pseudonymous browser ID). As required by theCCPA, we do not include that personal information in response to VerifiableConsumer Requests. If we cannot comply with a request, we will explain thereasons in our response.
Sale of Personal Information. We do not knowingly "sell" personalinformation that we collect from you, in accordance with the definition of"sell" in the CCPA, and will treat personal information we collectfrom you as subject to a do not sell request.
Shine the Light Law. California's "Shine the Light" law, CivilCode § 1798.83, requires certain businesses to respond to requests fromCalifornia customers asking about the businesses' practices related todisclosing personal information to third parties for the third parties' directmarketing purposes. We do not currently engage in the type of sharing coveredby this law and as a result, no such list exists. We do not make anyrepresentations concerning third parties that do not collect personalinformation directly through our services.
Miscellaneous. We will make commercially reasonable efforts to identifyconsumer personal information that we collect, process, store, disclose, andotherwise use and to respond to your CCPA rights requests. We will typicallynot charge a fee to fully respond to your requests, but we may charge areasonable fee, or refuse to act upon a request if your request is excessive,repetitive, unfounded, or overly burdensome. Also, we will not discriminateagainst you in a manner prohibited by the CCPA because you exercise your CCPArights. However, we may charge a different price or rate, or offer a differentlevel or quality of goods or services, to the extent that doing so isreasonably related to the value of the applicable data. In addition, we mayoffer you financial incentives for the collection, sale, and retention and useof your personal information as permitted by the CCPA that can, withoutlimitation, result in reasonably different prices, rates, or quality levels.The material aspects of any financial incentive will be explained and describedin its program terms. We may add or change incentive programs and/or theirterms by posting a notice on the program descriptions and terms linked to aboveso check them regularly.
Data Not Collected
Except asdescribed above, and as required to perform the application's corefunctionality at the user's request, Zeus apps do not send out any privateinformation. We do not collect:
· Information from devicesensors
· Your keyboard input
· Screen contents
· Network traffic
· Hostnames
· Usernames
· Passwords
· Encryption keys
· Messages you sendusing our products
· Contents of filesyou are working with
Apps like Zeus P2PMessenger, whose core purpose is to send and receive your messages anddocuments over a network, will, of course, send and receive your documents atyour request, but not to Zeus or any other third party.
Opting Out
Be aware that theoperating system may still collect crash logs and other analytics and send themto Apple, Microsoft or Google (depending on the operating system used) unlessyou have disabled that separately in the operating system's settings.
As you mightexpect, we keep backups of company data so that a catastrophic data loss eventdoesn't put us out of business.
Citizens of the EU may exercise their rights under the General Data Protection Regulation, such asthe rights of access and erasure, by contacting us with theirrequest.
